Terms & Agreements
Please read these Terms of Service ("Terms") carefully before using Yappie ("Service," "we," "us," or "our") at yappie.online. By creating an account, starting a free trial, or using the Service in any way, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. ELIGIBILITY
You must be at least 13 years old to use Yappie. If you are between 13 and 18, you may only use the Service with the verified consent of a parent or legal guardian, who also agrees to these Terms on your behalf.
By creating an account you represent and warrant that:
- (a) You are at least 13 years old.
- (b) You have the legal capacity to enter into a binding agreement.
- (c) All information you provide is accurate and complete.
2. DESCRIPTION OF SERVICE
Yappie is an AI-powered language learning application that lets you practice spoken conversations in a second language through real-time voice sessions. Features include:
- Live AI voice practice in multiple languages and regional accents.
- Scenario-based sessions (free conversation, restaurant, job interview prep).
- Automatic grammar and vocabulary correction drawn from your transcripts.
- Progress tracking: sessions, streaks, vocabulary list, and learning goals.
THE AI IS NOT A HUMAN. All conversation partners are AI systems powered by Google's Gemini models. Yappie makes no representation that using the Service will make you fluent or achieve any specific language learning outcome. Results depend entirely on the frequency and quality of your practice.
3. ACCOUNTS
3.1 Registration. You may register with an email and password or via Google OAuth. You are responsible for providing accurate information and keeping it up to date.
3.2 Account security. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately at help@yappie.online if you suspect unauthorized access.
3.3 One account per person. You may not create multiple accounts to circumvent free trials, rate limits, or any other restriction. We reserve the right to merge or terminate duplicate accounts.
3.4 Account deletion. You may request deletion of your account at any time by emailing help@yappie.online. Deletion is subject to the data-retention obligations described in our Privacy Policy.
4. FREE TRIAL
4.1 Trial period. New subscribers receive a 3-day free trial. No charge is applied during the trial period.
4.2 Trial speaking time. During the trial you receive a limited allotment of AI speaking time (currently 3,600 seconds / 60 minutes). This allotment is set at our discretion and may change without notice.
4.3 Conversion. At the end of the 3-day trial, your payment method is automatically charged the then-current weekly subscription fee unless you cancel before the trial ends. See Section 5 for cancellation details.
4.4 One trial per person. Free trials are limited to one per person and one per payment method. We reserve the right to revoke a trial if we detect abuse (e.g., multiple accounts created to obtain repeat trials).
4.5 Unauthenticated demo. The Yappie website may offer a brief, unauthenticated voice demo (currently 60 seconds) for visitors who have not yet created an account. This demo is provided as-is, with no guarantees, and may be withdrawn or modified at any time.
5. SUBSCRIPTIONS, BILLING, AND CANCELLATION
5.1 Subscription. Yappie offers a weekly recurring subscription. The current price is $9.99 USD per week (plus any applicable taxes), billed automatically each week via Stripe. Prices are displayed before you complete checkout and are subject to change with notice.
5.2 Speaking-time allotment. Each paid billing cycle grants you an allotment of AI speaking time (currently 8,400 seconds / 140 minutes per week). Unused time does NOT roll over to the next billing cycle — the allotment resets on each renewal.
5.3 Top-up purchases. You may purchase additional speaking time as a one-time payment ("top-up"). Top-up seconds are added to your balance and do not expire while your account is active, but are forfeited if your account is deleted.
5.4 Taxes. Prices shown are exclusive of taxes where required by law. Applicable sales tax, VAT, or GST will be calculated and added at checkout based on your billing location.
5.5 Failed payments. If a scheduled payment fails, we will retry according to Stripe's dunning schedule. Your access may be suspended during a past-due period.
5.6 Cancellation.
- (a) You may cancel your subscription at any time from your account settings.
- (b) Cancellation takes effect immediately. Your subscription will not renew, and you will not be charged again.
- (c) You retain access to any unused speaking-time seconds in your balance. You may continue to use them until they are exhausted.
- (d) Cancellation does not delete your account or your learning history.
5.7 No prorated refunds. We do not issue prorated refunds for the remainder of a billing cycle after cancellation. You keep and can use your remaining speaking-time balance as described in 5.6(c).
5.8 Refund policy. All purchases are final except where required by applicable law. If you believe you were charged in error, contact us within 14 days at help@yappie.online and we will investigate promptly.
5.9 Payment processing. All payment transactions are processed by Stripe, Inc. By subscribing, you also agree to Stripe's Terms of Service (https://stripe.com/legal). We do not store your full payment card details.
6. ACCEPTABLE USE
You agree not to use the Service to:
- (a) Violate any applicable law or regulation.
- (b) Impersonate any person or entity or misrepresent your affiliation.
- (c) Attempt to reverse-engineer, decompile, or extract the source code, system prompts, or AI model weights underlying the Service.
- (d) Use automated scripts, bots, or tools to generate sessions, bypass rate limits, or scrape content.
- (e) Circumvent billing controls, exploit trial offers multiple times, or manipulate session timing to obtain more speaking time than you have paid for.
- (f) Transmit any content that is unlawful, harassing, defamatory, obscene, or that infringes on third-party intellectual property rights.
- (g) Attempt to manipulate the AI into producing harmful, hateful, or otherwise policy-violating content.
- (h) Use the Service to train, fine-tune, or benchmark any competing AI model or language learning product.
- (i) Share your account credentials with others or resell access to the Service.
We reserve the right to suspend or terminate accounts that violate these rules without notice and without refund.
7. AI-GENERATED CONTENT
7.1 No guarantee of accuracy. The AI conversation partners in Yappie may occasionally produce incorrect grammar suggestions, inaccurate cultural information, or other errors. Do not rely solely on AI feedback for high-stakes language use (e.g., legal or medical contexts).
7.2 Conversation styles. Yappie offers multiple conversation styles, including "Street Slang," which may include informal, colloquial, or coarse language that reflects real-world usage. By selecting these modes, you acknowledge that the content may not be suitable for minors or all audiences.
7.3 No liability for AI output. We are not responsible for the accuracy, appropriateness, or completeness of any content generated by the AI. AI responses are generated by Google's Gemini models and are subject to Google's own usage policies and limitations.
7.4 Your content. By using the Service, you grant Yappie a limited, non-exclusive license to process, store, and display your conversation transcripts, vocabulary, and corrections solely for the purpose of providing the Service to you. We do not use your conversations to train AI models. We do not sell your content.
8. INTELLECTUAL PROPERTY
8.1 Our property. The Yappie name, logo, application design, system prompts, persona configurations, and all other original content created by us are our intellectual property and may not be copied, reproduced, or distributed without our prior written consent.
8.2 Your content. You retain ownership of content you create (e.g., your conversation transcripts). The license you grant us in Section 7.4 is solely to operate the Service.
8.3 Feedback. If you submit ideas, suggestions, or feedback about the Service, you grant us a perpetual, royalty-free right to use and incorporate that feedback without any obligation to compensate you.
9. THIRD-PARTY SERVICES
The Service depends on third-party services including Google (Gemini AI), Supabase (database and auth), Stripe (payments), Upstash (rate limiting), and Resend (contact form email delivery). Your use of these embedded services is also subject to their respective terms. We are not responsible for outages, errors, or policy changes by these providers that affect the availability or quality of the Service.
10. DISCLAIMER OF WARRANTIES
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
WE DO NOT WARRANT THAT:
- THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.
- AI RESPONSES WILL BE ACCURATE, COMPLETE, OR APPROPRIATE FOR YOUR PURPOSE.
- THE SERVICE WILL MEET YOUR SPECIFIC LANGUAGE LEARNING GOALS OR PRODUCE ANY PARTICULAR EDUCATIONAL OUTCOME.
SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES. IF THIS APPLIES TO YOU, THE ABOVE EXCLUSIONS MAY NOT APPLY IN FULL.
11. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL YAPPIE, ITS OWNER, OR ITS SERVICE PROVIDERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE.
IN ALL CASES, OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM THESE TERMS OR YOUR USE OF THE SERVICE SHALL NOT EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID TO YAPPIE IN THE 30 DAYS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) $10.00 USD.
SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS OF LIABILITY. IF YOU ARE IN SUCH A JURISDICTION, SOME OF THESE LIMITATIONS MAY NOT APPLY TO YOU.
12. INDEMNIFICATION
You agree to indemnify, defend, and hold harmless Yappie and its owner from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with:
- (a) Your access to or use of the Service.
- (b) Your violation of these Terms.
- (c) Your violation of any third-party right, including intellectual property or privacy rights.
- (d) Any content you transmit through the Service.
13. SERVICE AVAILABILITY AND MODIFICATIONS
13.1 Availability. We strive for high availability but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, third-party outages (including Google Gemini), or factors outside our control. We are not liable for downtime.
13.2 Modifications. We reserve the right to modify, suspend, or discontinue any part of the Service at any time. If we discontinue the Service entirely, we will provide at least 14 days' notice by email and will not charge any further subscription fees after the notice date.
13.3 Pricing changes. We will notify you by email at least 14 days before any increase in subscription pricing. Your continued use after the effective date constitutes acceptance of the new price.
13.4 Feature changes. Individual features (e.g., specific languages, accents, or session modes) may be added, changed, or removed without notice, provided that the core AI voice practice functionality continues to be available.
14. TERMINATION
14.1 By you. You may stop using the Service and cancel your subscription at any time per Section 5.6.
14.2 By us. We may suspend or terminate your account immediately and without prior notice if we believe you have violated these Terms, engaged in fraudulent activity, or posed a risk to other users or the Service. In such cases, no refund will be issued.
14.3 Effect of termination. Upon termination of your account for any reason, your right to access the Service ends immediately. Sections 7.4, 8, 10, 11, 12, and 15 survive termination.
15. GOVERNING LAW AND DISPUTE RESOLUTION
15.1 Governing law. These Terms are governed by the laws of the State of California, United States, without regard to conflict-of-law principles.
15.2 Informal resolution. Before filing a formal dispute, you agree to contact us at help@yappie.online and give us 30 days to attempt to resolve the issue informally.
15.3 Binding arbitration. If informal resolution fails, any dispute arising from these Terms or the Service shall be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, except that either party may bring claims in small claims court for disputes within that court's jurisdiction.
15.4 Class action waiver. YOU AGREE THAT CLAIMS MAY ONLY BE BROUGHT IN YOUR INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.
15.5 EU/UK consumers. Nothing in this section removes or limits any mandatory rights you have under the consumer protection laws of the European Union or United Kingdom. Consumers in those regions retain the right to bring claims before their local courts.
16. CHANGES TO THESE TERMS
We may update these Terms at any time. When we do, we will revise the "Last updated" date at the top. For material changes (e.g., changes to pricing, arbitration, or data rights), we will notify you by email at least 14 days before the changes take effect. Your continued use of the Service after the effective date constitutes your acceptance of the revised Terms.
If you do not agree with any change, you may cancel your subscription and stop using the Service before the effective date.
17. MISCELLANEOUS
Entire agreement. These Terms, together with the Privacy Policy, constitute the entire agreement between you and Yappie regarding the Service and supersede all prior agreements.
Severability. If any provision of these Terms is found invalid or unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will continue in full force.
No waiver. Our failure to enforce any right or provision does not constitute a waiver of that right or provision.
Assignment. You may not assign or transfer your rights under these Terms. We may assign our rights to a successor in the event of a merger, acquisition, or sale of substantially all of our assets, and will notify you if we do so.
